Terms and Conditions of Sale and Warranty for Customers

Effective as of: September 1, 2026

1. Säljare and contact information

Products under the Estcomhaus brand are sold by:

ESTCOM GRUPP OÜ
Registration number: 11288493
Registered address: Piiri tn 18-54, 63304 Põlva, Estonia
Production: Lao tee 3, Himmaste, Põlva Municipality, Estonia
Email: info@estcomhaus.com
Phone: +372 513 0304
Website: estcomhaus.com

The company's registered address and registration number match those listed in the Estonian Business Register.

In these terms and conditions, ESTCOM GRUPP OÜ is referred to as Estcomhaus, and the seller and the buyer are referred to as the customer.

2. Application of the Terms and Conditions

These terms and conditions of sale and warranty apply to modular saunas, construction kits, sauna heaters, chimneys, control systems, lighting, accessories, and other products that Estcomhaus sells to customers in Sweden.

Estcomhaus sells products to both individuals and businesses.

For a private individual who purchases a product primarily for personal use, the mandatory consumer rights under Swedish law also apply. These terms and conditions do not limit such rights.

For business customers, these terms and conditions apply in conjunction with the individual quote and any other written agreements between the parties.

For each individual order, the quote and product specifications approved by the customer shall take precedence.

3. Custom Manufacturing and Individual Configuration

Estcomhaus saunas are manufactured to order and based on the configuration approved by the customer before production begins.

Depending on the sauna model, the customer can choose, among other things:

  • material for the interior cladding;
  • material for the exterior cladding;
  • color and exterior finish;
  • type and model of sauna heater;
  • an electric or wood-fired unit, if the sauna model is designed for both options;
  • control system for the unit;
  • outdoor lighting;
  • chimney system;
  • accessories and other agreed-upon solutions.

The customer’s choice affects how the individual sauna is manufactured. Different sauna heaters may require different recesses, penetrations, electrical preparations, and structural solutions. When choosing a wood-fired heater, the structure is prepared for the chimney penetration. If outdoor lighting is selected, the necessary electrical preparations and recesses are made. Interior and exterior materials, as well as surface treatments, are carried out in accordance with the approved order.

Bastun is therefore manufactured for a specific customer, and once production has begun, it may be difficult or impossible to sell it to another customer without modifications, material substitutions, or other significant costs.

For a product that is manufactured according to the consumer’s instructions or that is otherwise clearly personalized, the standard 14-day right of withdrawal under the Swedish Distance Contracts Act does not apply.

4. Proposal and Order Specifications

Before the order is confirmed, Estcomhaus prepares a customized written quote.

Depending on the order, the following information is provided, among other things:

  • base model and version;
  • measure;
  • material for interior cladding;
  • material for exterior cladding;
  • exterior color and finish;
  • type and model of the unit;
  • control system;
  • lighting;
  • chimney solution, if included;
  • with the rest of the dill;
  • delivery terms;
  • shipping address;
  • pris;
  • transportation costs;
  • Estimate production and delivery times;
  • other special agreements.

Before confirming the order, the customer must verify that all information, selections, and technical solutions in the quote correspond to the customer's preferences.

The quotation approved by the customer, together with any drawings, technical specifications, and subsequent changes approved in writing, constitutes the final order specification.

Images, renderings, and product images on the website and in marketing materials are for illustrative purposes only. The individually approved order specification applies to the order in question.

Wood is a natural material, and minor variations in color, texture, grain, and knots may occur.

5. Order Confirmation and Full Payment

The order is considered confirmed when:

  1. the customer has approved the quote and the order specifications in writing;
  2. Estcomhaus has received all the information and specifications needed for production;
  3. The customer has paid 100% of the order price as stated on the issued invoice.

Estcomhaus will not begin production until full payment has been received and the final configuration has been approved.

Explicit approval via email is considered written approval.

6. Price, Shipping, and Sales Tax

Prices for the sauna and other ordered products are listed in the individual quote.

Shipping costs will be charged separately, unless otherwise expressly stated in the quote.

For individual customers, the final price is stated inclusive of the VAT to be charged in accordance with applicable VAT regulations.

If the customer is a Swedish company with a valid Swedish VAT number and the goods are transported from Estonia to Sweden, the sale may—provided all statutory conditions are met—be invoiced as an intra-Community supply with 0% Estonian VAT. The customer then normally reports Swedish VAT on the intra-Community acquisition in Sweden.

The customer must provide a valid VAT number before the invoice is issued. If the conditions for a VAT-exempt intra-Community supply are not met, VAT will be charged in accordance with the rules applicable to the transaction in question.

7. Changes After a Confirmed Order

After the order has been confirmed, the customer may request changes, such as to:

  • unit;
  • internal material;
  • external material;
  • exterior color or finish;
  • lighting;
  • control system;
  • accessories;
  • other parts of the approved configuration.

Whether a change can be made depends on how far along production is.

If the change is still possible, Estcomhaus will notify the customer of any additional costs and whether the change will affect the production or delivery time.

A change may result in a new price, additional material or labor costs, and a later delivery date.

If the relevant part has already been manufactured or if it is no longer technically feasible to make the change, Estcomhaus has the right to reject the request for a change.

A change is effective only after it has been confirmed in writing by both parties.

8. Production and Delivery Time

For saunas delivered to Sweden, the standard production and delivery time is usually up to about two months.

The time was counted from the moment when:

  • The order has been confirmed;
  • once payment has been received;
  • Estcomhaus has received all the information needed for production.

The estimated production and delivery time for this order is specified in the quote.

Delivery times may be affected by subsequent changes made by the customer, late submission of information or components by the customer, special customizations, and other circumstances that affect current production or transportation.

If a significant delay occurs, Estcomhaus will notify the customer as soon as possible and, when possible, provide a new estimated delivery date.

Estimated delivery times do not constitute a guaranteed exact delivery date unless a specific date has been expressly agreed upon in writing.

This provision does not affect the consumer's statutory rights in the event of a delay.

9. Form of Delivery

The delivery method depends on the sauna model ordered.

Some models are available either fully assembled or as a kit, while other models are available only fully assembled.

The delivery method applicable to the current order is specified in the quote.

The sauna is delivered as a kit and includes assembly instructions. For example, the Estcomhaus product sheet lists both fully assembled delivery and DIY options for certain Basic models.

10. Shipping to Sweden

Unless otherwise specified in the quote, Estcomhaus will arrange transportation to the delivery address in Sweden approved by the customer.

Shipping costs are listed separately.

Prior to delivery, the customer must provide accurate and sufficient information regarding the delivery location and availability.

Estcomhaus should be informed of any conditions that may affect transportation or unloading, such as restricted access roads, narrow gates, sharp turns, insufficient bearing capacity, steep slopes, low-hanging power lines, trees, limited maneuvering space, or other obstacles.

If the customer has not informed Estcomhaus of a significant limitation and this results in delays, reloading, new transportation, or other additional costs, the customer may be charged reasonable costs incurred as a result.

11. Liability During Transportation

When transportation is arranged by Estcomhaus, Estcomhaus is responsible for the sauna during transportation until it has been handed over to the customer or to a person designated by the customer to receive it at the agreed-upon delivery address.

If the sauna is damaged during transport, the customer must contact Estcomhaus as soon as possible. Estcomhaus will handle the matter with the shipping company and is responsible to the customer for ensuring that the transport damage is handled in accordance with these terms and conditions and applicable law.

For a consumer, the risk of loss or damage to the goods normally passes only when the goods have been delivered. If the seller has arranged for transportation, the goods are not considered delivered merely by being handed over to the carrier.

If the customer arranges the entire shipment on their own and hires a carrier that Estcomhaus has not offered as a delivery option, the risk passes, in accordance with applicable law, when the sauna is handed over to the carrier chosen by the customer.

12. Unloading and Lifting

Estcomhaus's shipping to Sweden includes delivery to the agreed-upon delivery address.

Unloading, crane lifting, and placement of the sauna at its final installation site are not included in the standard transportation service, unless otherwise expressly stated in the quote.

The customer is responsible for ensuring that appropriate lifting equipment is available on the delivery date.

A pre-assembled sauna may require a crane, forklift, or other lifting equipment with sufficient capacity.

The customer is responsible for any unloading or lifting contractor that the customer hires.

Estcomhaus is not liable for damage caused by improper unloading, lifting, or handling performed by the customer or by a third party engaged by the customer.

13. Inspection of the Product upon Delivery

Upon delivery of the sauna, the customer should visually inspect the sauna, the packaging, and the visible parts of the shipment.

If there is visible damage that may have occurred during shipping, the customer should:

  • Take a photo of the damage before the sauna is moved or unloaded;
  • Take a photo of the damaged packaging;
  • if possible, take a photo of the transport vehicle;
  • if possible, note any visible damage on the carrier's shipping document;
  • Please contact Estcomhaus as soon as possible.

To ensure that the damage can be reliably assessed before unloading, it must be documented before the lifting operation begins.

The documentation makes it possible to distinguish between damage that occurred during transport and damage that occurred during unloading or subsequent handling.

If a defect or damage could not reasonably have been detected at the time of delivery, this does not affect a consumer’s statutory right to file a complaint.

14. Preparation of the Delivery and Installation Site

Before the sauna arrives, the customer must ensure that the site is ready for delivery.

There must be sufficient accessibility, a prepared and suitable surface, enough space for lifting and placement, and no obstacles that could make transport or unloading unsafe.

If the site is not ready on the agreed delivery date and the sauna therefore cannot be unloaded or installed safely, a new delivery or other additional service may result in extra costs.

15. Sauna Floor

The sauna bench must be placed on a level, stable, horizontal, and sufficiently load-bearing surface.

Depending on the installation site, a suitable foundation could be, for example, a concrete slab, properly placed concrete blocks, a sufficiently sturdy deck, or another structure designed to support the weight of the sauna and accommodate local conditions.

The foundation must be able to support the sauna's own weight, as well as the weight of the heating unit, sauna benches, any chimney, accessories, and the load generated during use.

The customer is responsible for ensuring that the subgrade is suitable and has sufficient bearing capacity.

Estcomhaus is not liable for damage caused by an unstable, uneven, or insufficiently load-bearing surface.

16. Assembly of a sauna delivered as a kit

Saunas delivered as kits must be assembled according to Estcomhaus's assembly instructions.

Before beginning installation, the customer should check that the delivery is complete, read through the installation instructions, prepare a suitable and level surface, and use appropriate tools and work methods.

If there is any uncertainty about how a part should be installed, the customer should contact Estcomhaus before continuing with the work.

Estcomhaus is not liable for damage caused by improper installation, failure to follow the instructions, or design modifications made without Estcomhaus's approval.

This does not affect Estcomhaus's liability for material or manufacturing defects in the delivered parts.

17. Installation Services in Sweden

Unless otherwise expressly stated in the quote, on-site assembly or installation in Sweden is not included in the purchase price or shipping costs.

Therefore, the standard delivery does not include the construction of a foundation, crane or lifting services, assembly of a DIY kit, connection to the property’s electrical system, water or sewer installation, final installation of a wood-burning unit and chimney, or applications for building permits and other local permits.

If any of these services are to be contracted separately, this will be specified in the quote.

18. Electric Sauna Heater and Electrical Installation

The sauna is prepared at the factory for the electrical unit and the electrical options specified in the order.

Different generators may require different power ratings, connections, control systems, and installation methods. Depending on the generator, a three-phase connection may be required. The Estcomhaus product sheet also states that a three-phase connection may be necessary depending on the generator selected.

Before placing an order, the customer must ensure that the property can provide the electrical connection required by the selected solution.

Factory preparations do not involve the final connection of the unit or sauna to the customer’s electrical system in Sweden.

Electrical installation work on another party’s electrical system in Sweden must be performed by an electrical installation company registered with the Swedish Electrical Safety Authority for the specific type of work.

Estcomhaus is not liable for damage caused by incorrect voltage, incorrect phase connection, an inadequate power grid, inadequate protection, installation that does not meet applicable requirements, or unauthorized modifications to the electrical equipment.

The limitation of liability applies only when there is a causal link between the improper installation and the damage in question.

19. The heating unit and chimney

The liquefied unit can be installed in a sauna model designed specifically for this solution.

When a wood-fired unit is included in the order, the sauna is prepared for that unit and the chimney solution specified in the approved specifications.

The customer is responsible for ensuring that the final on-site installation in Sweden complies with applicable requirements regarding fire safety, safety clearances, chimneys, and installation.

Customers should also check which notifications, permits, or other approvals are required by the municipality before the installation is put into use. The installation of a fireplace or flue may be subject to a notification requirement under Swedish building regulations.

Estcomhaus is not liable for damage caused by improper installation of the unit or chimney at the installation site.

20. Building Permits and Local Requirements

Before confirming the order, the customer should verify which building, zoning, fire safety, and other local requirements apply to the placement of the sauna on the property in question.

The need for a building permit, notification, or other authorization may be influenced by, among other things, the property’s location, the zoning plan, the size and height of the sauna, its placement on the lot, the distance to the lot line, existing buildings, the chosen heating solution, the chimney, and the water and sewer systems.

Estcomhaus can, if necessary, provide the dimensions and technical product specifications that the customer needs when dealing with the municipality.

The customer is responsible for ensuring that the necessary local permits and approvals are in place before the sauna is installed and put into use.

21. Snowfall and Local Climate Conditions

The standard snow load for each sauna model is specified in the product sheet or in the individual order specification.

Before placing an order, the customer should verify which design requirements apply at the installation site.

If the design snow load at the installation site exceeds that of the sauna's standard model, Estcomhaus must be notified of this before the order is confirmed.

Estcomhaus can then assess the possibility of reinforcing or otherwise modifying the structure.

Estcomhaus is not liable for damage caused by snow load or other external loads that exceed the load for which the ordered structure is designed, unless the customer has informed Estcomhaus of the local conditions.

22. Cancellation of a Consumer Order

If a residential customer wishes to cancel an order for a sauna before it has been delivered, the customer must notify Estcomhaus in writing as soon as possible.

Since the sauna is manufactured to the individual customer’s order, Estcomhaus may, at the time of cancellation, have already ordered materials and components, carried out structural work, prepared openings and connections for the heating unit, completed electrical preparations, prepared the chimney penetration, or installed the interior or exterior materials and finishes selected by the customer.

In the event of a cancellation, Estcomhaus is entitled to compensation for the specific costs and other reasonable financial losses caused by the cancellation.

The following factors, among others, may be taken into account in the calculation: materials and components already purchased, work already performed, production preparations, customer-specific work, direct additional costs, and other reasonable financial losses.

Compensation is assessed based on factors such as the price of the order, the stage of production, the scope of work performed, the degree of customization, and the possibility of selling the finished or partially finished sauna to another customer.

Since the sauna has already been manufactured largely according to the customer’s specific configuration and cannot be resold without significant modifications or financial loss, the reasonable compensation may, depending on the circumstances, amount to the full amount paid by the customer.

If the prepaid amount exceeds the compensation to which Estcomhaus is entitled under applicable law, the excess amount will be refunded.

Under Swedish consumer sales law, a consumer may cancel an order before delivery, while the seller may claim compensation for certain costs and other reasonable losses resulting from the cancellation.

23. Cancellation of an Order by a Business Customer

An order from a business customer is binding upon written confirmation and payment.

A business customer does not have the right to unilaterally cancel an order for a custom-made sauna at no cost after the order has been confirmed, unless Estcomhaus approves the cancellation in writing.

If Estcomhaus approves a cancellation, any refund will be determined based on the stage of production, work performed, materials purchased, components ordered, customer-specific work, the ability to resell the product, and other costs incurred as a result of the cancellation.

In special cases, Estcomhaus may approve a full or partial refund if production and order preparation have not yet begun. This does not constitute a general right for business customers to cancel their orders free of charge.

24. Immediate delivery at the customer's request

If the sauna is ready but the customer is unable to accept delivery at the agreed time, the customer must notify Estcomhaus as soon as possible.

If the delivery must be postponed for a reason attributable to the customer, the customer may be charged for reasonable additional costs, such as those related to storage, rescheduling of transportation, new transportation, or the waiting time of the transport vehicle.

A new delivery date will be agreed upon separately.

25. Estcomhaus 2-Year Warranty

Estcomhaus provides a 2-year warranty on saunas manufactured by Estcomhaus.

The warranty period begins when the sauna is delivered to the customer, unless a longer warranty period is expressly specified in the individual quote.

The warranty covers manufacturing and material defects, as well as defects in Estcomhaus’s workmanship that become apparent during the warranty period and that are not due to improper installation, use, maintenance, or any other circumstance beyond Estcomhaus’s control.

Estcomhaus's current product sheet specifies a two-year warranty for its sauna models.

If a defect is covered by the warranty, Estcomhaus will determine the appropriate course of action based on the nature of the defect.

The 2-year warranty does not limit a consumer's statutory right to file a complaint.

26. Warranty for Sauna Heaters and Products from Other Manufacturers

For sauna heaters, control systems, and other third-party products, the respective manufacturers’ warranty terms apply to the extent that the manufacturer has provided a warranty.

If the product was purchased from Estcomhaus as part of a sauna order, a residential customer may also file a complaint with Estcomhaus as the seller.

A manufacturer's warranty does not replace the consumer's statutory rights against the seller. The Consumer Agency states that complaints should be directed to the company from which the customer purchased the item.

27. Damage and defects not covered by the Estcomhaus warranty

Estcomhaus's commercial warranty does not cover defects or damage to the extent that they are caused by:

  • normal wear and tear;
  • improper use;
  • if the installation or operating instructions have not been followed;
  • incorrect installation of a DIY sauna;
  • settling, uneven, or insufficiently load-bearing subgrade;
  • incorrect electrical installation;
  • voltage or phase connection;
  • improper installation of a heating unit or chimney;
  • damage caused by improper unloading or lifting;
  • inadequate or improper maintenance;
  • design changes made by the customer or a third party without Estcomhaus's approval;
  • any unit or equipment not approved for use in the sauna by Estcomhaus, if such equipment caused the damage;
  • snow load or other load that exceeds the structure's design capacity;
  • freeze damage to systems not designed for use with water at sub-zero temperatures;
  • flooding or other external water damage;
  • other external circumstances not attributable to a material or manufacturing defect on the part of Estcomhaus.

The exception applies only when there is a causal link between the relevant circumstance and the damage.

For example, the fact that electrical work was performed by a third party does not automatically mean that the warranty for the entire sauna is void if a subsequent defect is unrelated to that electrical work.

28. The Natural Properties of Wood

Wood is a natural material.

Due to temperature, humidity, use, and weather conditions, wood may change over time.

Among other things, there may be natural color variations, variations in grain and texture, minor dimensional changes, and minor surface cracks resulting from drying.

Such natural characteristics are not in themselves considered defects in materials or workmanship, as long as they do not significantly affect the sauna’s safety, load-bearing structure, or normal use.

29. Care and Maintenance

The sauna must be used and maintained in accordance with Estcomhaus’s guidelines and the instructions for the generator and other technical equipment.

After use, the sauna should be ventilated and allowed to dry thoroughly.

The steam generator should be cleaned with products suitable for sauna environments.

Wooden fences should be inspected regularly and treated as needed, depending on the surface treatment, weather conditions, exposure, and use.

The heating unit, chimney, control system, and other technical equipment must be maintained in accordance with the respective manufacturers' instructions.

30. Complaints

If a customer discovers a possible defect in the sauna or in a product purchased from Estcomhaus, Estcomhaus must be contacted in writing:

info@estcomhaus.com

Complaints should, to the extent possible, include the customer's name and contact information, the order or invoice number, the sauna model, a description of the defect, photographs, and, if necessary, a video, as well as information about when the defect was discovered.

If the problem may be related to an electrical installation, a sauna heater, a chimney, installation work, or other technical work, Estcomhaus may request additional documentation regarding the installation.

Before the customer allows a third party to perform a major repair, Estcomhaus must be given a reasonable opportunity to assess the problem and propose a solution, except when immediate action is necessary to prevent danger or further damage.

31. Right to File a Complaint for Individual Customers

Under the Consumer Sales Act, a private customer in Sweden has a three-year right to file a complaint regarding defects for which the seller is liable.

A complaint must be filed within a reasonable time after the customer discovered or should have discovered the defect. A complaint filed within two months of the discovery of the defect is always considered to have been filed in a timely manner.

If a defect becomes apparent within two years after the goods were delivered, the defect shall, as a general rule, be deemed to be one for which the seller is liable, unless the seller proves otherwise or the presumption is inconsistent with the nature of the goods or the defect.

The fact that Estcomhaus’s 2-year warranty expires does not therefore automatically mean that the consumer’s statutory 3-year right to file a complaint ceases.

32. Action Taken Upon Acceptance of a Complaint

If Estcomhaus is responsible for the identified fault, Estcomhaus shall be given a reasonable opportunity to assess and rectify the fault.

Depending on the nature of the defect, the solution may, for example, involve repair, replacement of a defective part, delivery of a new component, or another appropriate measure.

The consumer's rights under the Consumer Sales Act, including the right to rectification, replacement, and, where permitted by law, a price reduction or cancellation, are not affected by these terms and conditions.

33. Work Performed by Third Parties

If the customer hires a third party to perform lifting, assembly, electrical installation, chimney installation, foundation work, plumbing, or other work related to the sauna, the contractor hired is responsible for ensuring that the work is performed correctly.

Estcomhaus is not liable for damages caused by the work of a third party.

However, the fact that the customer uses a third party does not relieve Estcomhaus of liability for any separate material or manufacturing defect in the sauna.

34. Generators or other equipment purchased by the customer

If the customer wishes to use a unit or other technical equipment not purchased from Estcomhaus, the solution must be approved in writing by Estcomhaus before production begins, if the equipment affects the sauna’s construction.

The customer must provide, well in advance, all technical information that Estcomhaus needs for production, such as the exact model, dimensions, installation instructions, safety clearances, electrical requirements, control systems, and information regarding the chimney or other penetrations.

Estcomhaus is not responsible for product defects, warranties, or the functionality of equipment that the customer has purchased directly from another supplier.

Estcomhaus remains responsible for the work and construction that Estcomhaus has performed itself.

35. Circumstances Beyond Estcomhaus's Control

If the fulfillment of the order is prevented or significantly delayed by extraordinary circumstances beyond Estcomhaus’s reasonable control, the customer will be notified as soon as possible.

This may, for example, involve war or armed conflict, a major natural disaster, a decision by a public authority, closed borders or transportation corridors, or another comparable and reasonably unforeseeable event.

Estcomhaus will take reasonable measures to limit the consequences and, where possible, fulfill the order or agree on an alternative solution with the customer.

This provision does not limit the consumer's mandatory statutory rights.

36. Limitation of Liability for Business Customers

This section applies only to business customers.

To the extent permitted by applicable law, Estcomhaus shall not be liable for indirect financial losses incurred by a business customer, such as lost profits, loss of production, business interruption, or other indirect losses, unless such losses were caused by Estcomhaus’s willful misconduct or gross negligence.

Estcomhaus’s contractual liability to a business customer is, to the extent permitted by law, limited to the value of the order in question.

37. Applicable Law

The agreement between Estcomhaus and the customer shall be governed by Estonian law.

If the customer is a consumer domiciled in Sweden, the choice of law does not mean that the customer loses the protection afforded by such mandatory Swedish consumer protection provisions that would have been applicable in the absence of the choice of law. This also follows from the EU’s Rome I Regulation on consumer contracts.

38. Disputes

In the event of questions, complaints, or disputes, the customer should first contact Estcomhaus:

info@estcomhaus.com

Estcomhaus and the customer should first attempt to resolve the issue through direct contact and a reasonable agreement.

If a dispute with a Swedish private customer cannot be resolved directly, the customer may, provided the case meets the board’s requirements, file a complaint with the Swedish National Board for Consumer Complaints (ARN). ARN may also hear certain disputes involving companies outside Sweden when the company targets the Swedish market or has a sufficient connection to Sweden.

Disputes with corporate customers shall first be resolved through negotiation and, if a resolution cannot be reached, by a competent court in accordance with applicable law.

39. Validity and Amendments to the Terms and Conditions

For an order, the version of these Terms and Conditions of Sale and Warranty that was available to the customer at the time the order was confirmed applies.

Estcomhaus may change the terms and conditions for future orders.

Any subsequent amendment to the terms and conditions shall not affect the terms and conditions of an order that has already been confirmed, unless otherwise agreed upon in a separate agreement between Estcomhaus and the customer.

If any single provision of these terms and conditions were to be invalid, in whole or in part, this would not automatically affect the validity of the remaining provisions.
