Sales and Warranty terms

Effective from: 01.09.2026

1. Seller and contact details

Products under the Estcomhaus brand are sold by:

ESTCOM GRUPP OÜ
Company registration number: 11288493
Registered address: Piiri tn 18-54, 63304 Põlva, Estonia
Production facility: Lao tee 3, Himmaste, Põlva Parish, Estonia
Email: info@estcomhaus.com
Phone: +372 513 0304
Website: estcomhaus.com

In these terms, ESTCOM GRUPP OÜ is referred to as Estcomhaus or the Seller, and the purchaser is referred to as the Customer.

2. Application of these terms

These Sales and Warranty Terms apply to modular saunas, sauna kits, sauna heaters, chimney systems, control systems, lighting, accessories and other products sold by Estcomhaus to customers in Sweden.

Estcomhaus sells products to both private consumers and businesses.

Where the Customer is a private individual purchasing primarily for personal use, the mandatory consumer rights provided under Swedish law also apply. Nothing in these terms limits any rights that cannot legally be restricted by contract.

For business customers, these terms apply together with the individual quotation and any other written agreements between the parties.

For each individual order, the quotation and product specification approved by the Customer take precedence.

3. Custom-made products and individual configuration

Estcomhaus saunas are manufactured to order based on the final configuration approved by the Customer before production begins.

Depending on the sauna model, the Customer may choose, among other things:

  • the material for the interior cladding;
  • the material for the exterior cladding;
  • the exterior colour and surface finish;
  • the type and model of sauna heater;
  • an electric or wood-burning heater, where the selected sauna model supports both options;
  • the heater control system;
  • exterior lighting;
  • the chimney system;
  • accessories and other agreed solutions.

The Customer’s choices affect how the individual sauna is manufactured. Different sauna heaters may require different recesses, penetrations, electrical preparations and structural solutions. Where a wood-burning heater is selected, the sauna structure is prepared for the chimney penetration. Where exterior lighting is selected, the necessary electrical preparations and recesses are made. Interior and exterior materials and finishes are completed according to the approved order.

The sauna is therefore manufactured specifically for the individual Customer and, once production has started, it may be difficult or impossible to sell it to another customer without reconstruction, replacement of materials or other significant additional costs.

Goods manufactured according to the consumer’s instructions or otherwise clearly personalised are not subject to the standard 14-day right of withdrawal under Swedish distance-selling legislation.

4. Quotation and order specification

Before the order is confirmed, Estcomhaus prepares an individual written quotation for the Customer.

Depending on the order, the quotation may include:

  • sauna model and version;
  • dimensions;
  • interior cladding material;
  • exterior cladding material;
  • exterior colour and surface finish;
  • type and model of sauna heater;
  • control system;
  • lighting;
  • chimney solution, where applicable;
  • other optional equipment;
  • delivery method;
  • delivery address;
  • product price;
  • transport cost;
  • estimated production and delivery time;
  • other specific agreements relating to the order.

Before confirming the order, the Customer must check that all details, selections and technical solutions stated in the quotation correspond to the Customer’s requirements.

The quotation approved by the Customer, together with any drawings, technical specifications and subsequent written amendments approved by both parties, constitutes the final order specification.

Images, visualisations and product photographs displayed on the website or in marketing materials are illustrative. The individually approved order specification governs the actual order.

Wood is a natural material and minor differences in colour, grain, texture and knots may occur.

5. Order confirmation and full payment

An order is considered confirmed when:

  1. the Customer has approved the quotation and order specification in writing;
  2. Estcomhaus has received all information and selections required for production;
  3. the Customer has paid 100% of the order value in accordance with the issued invoice.

Estcomhaus will not begin production until full payment has been received and the final configuration has been approved.

A clear confirmation by email is considered written approval.

6. Prices, transport and VAT

The price of the sauna and other ordered products is stated in the individual quotation.

Transport costs are charged separately, unless expressly stated otherwise in the quotation.

For private consumers, the final price will include the VAT applicable to the transaction.

Where the Customer is a Swedish company with a valid Swedish VAT number and the goods are transported from Estonia to Sweden, the sale may, provided all legal requirements are met, be invoiced as an intra-Community supply with 0% Estonian VAT. The Swedish customer will then normally account for Swedish VAT on the intra-Community acquisition in Sweden.

The Customer must provide a valid VAT number before the invoice is issued. If the requirements for a VAT-exempt intra-Community supply are not fulfilled, VAT will be charged according to the rules applicable to the transaction.

7. Changes after order confirmation

After the order has been confirmed, the Customer may request changes to, for example:

  • the sauna heater;
  • interior material;
  • exterior material;
  • exterior colour or finish;
  • lighting;
  • control system;
  • accessories;
  • other parts of the approved configuration.

Whether a requested change can be made depends on how far production has progressed.

If the change is still possible, Estcomhaus will inform the Customer of any additional cost and whether the change will affect production or delivery time.

A change may result in a revised price, additional material or labour costs and a later delivery date.

If the affected part has already been manufactured or the requested change is no longer technically reasonable to carry out, Estcomhaus may refuse the requested change.

A change becomes binding only once it has been confirmed in writing by both parties.

8. Production and delivery time

For saunas delivered to Sweden, the normal production and delivery time is usually up to approximately two months.

The period is calculated from the date on which:

  • the order has been confirmed;
  • full payment has been received;
  • Estcomhaus has received all information required for production.

The estimated production and delivery time for the individual order is stated in the quotation.

Delivery time may be affected by later changes requested by the Customer, delayed information or components supplied by the Customer, special customisations or other circumstances affecting production or transport.

If a significant delay occurs, Estcomhaus will inform the Customer as soon as possible and, where possible, provide a revised estimated delivery time.

An estimated delivery time does not constitute a guaranteed exact delivery date unless a specific date has been expressly agreed in writing.

A consumer’s statutory rights in the event of delayed delivery remain unaffected.

9. Delivery form

The delivery form depends on the sauna model ordered.

Certain models may be supplied either fully assembled or as a DIY kit, while other models are supplied only fully assembled.

The delivery form applicable to the individual order is stated in the quotation.

Where a sauna is supplied as a DIY kit, assembly instructions are included.

10. Transport to Sweden

Unless otherwise stated in the quotation, Estcomhaus arranges transport to the delivery address in Sweden approved by the Customer.

Transport costs are stated separately.

Before delivery, the Customer must provide correct and sufficient information about the delivery location and accessibility.

Estcomhaus must be informed of any circumstances that could affect transport or unloading, including:

  • restricted access roads;
  • narrow gates;
  • sharp turns;
  • insufficient road load-bearing capacity;
  • steep gradients;
  • low overhead power lines;
  • trees;
  • limited manoeuvring space;
  • other obstacles.

If the Customer fails to inform Estcomhaus of a significant access restriction and this results in waiting time, reloading, repeat transport or other additional costs, the Customer may be charged the reasonable costs incurred as a result.

11. Responsibility during transport

Where transport is arranged by Estcomhaus, Estcomhaus is responsible for the sauna during transport until it has been handed over to the Customer or to a person appointed by the Customer to receive it at the agreed delivery address.

If the sauna is damaged during transport, the Customer must contact Estcomhaus as soon as possible. Estcomhaus will handle the matter with the transport company and will be responsible towards the Customer for resolving the transport damage in accordance with these terms and applicable law.

For consumers, the risk relating to the goods normally transfers only when the goods have been handed over. Where the delivery option has been offered by the Seller, the goods are not considered handed over merely because they have been transferred to the carrier.

If the Customer arranges the entire transport independently and appoints a carrier that Estcomhaus has not offered as a delivery option, the risk transfers in accordance with applicable law when the sauna is handed over to the carrier selected by the Customer.

12. Unloading and lifting

Estcomhaus transport to Sweden includes transportation to the agreed delivery address.

Unloading, crane lifting and placement of the sauna at its final installation location are not included in the standard transport service, unless expressly stated otherwise in the quotation.

The Customer is responsible for ensuring that suitable lifting equipment is available on the delivery date.

A fully assembled sauna may require a crane, forklift or other lifting equipment with sufficient capacity.

The Customer is responsible for any unloading or lifting contractor appointed by the Customer.

Estcomhaus is not responsible for damage caused by incorrect unloading, lifting or handling carried out by the Customer or by a third party appointed by the Customer.

13. Inspection of the product upon delivery

When the sauna arrives, the Customer must visually inspect the sauna, packaging and all visible parts of the delivery.

If possible transport damage is visible, the Customer must:

  • photograph the damage before the sauna is moved or unloaded;
  • photograph any damaged packaging;
  • where possible, photograph the transport vehicle;
  • where possible, record the visible damage on the carrier’s transport documentation;
  • contact Estcomhaus as soon as possible.

If the damage can be safely assessed before unloading, it must be documented before lifting work begins.

This documentation makes it possible to distinguish damage that occurred during transport from damage caused during unloading or subsequent handling.

If a defect or damage could not reasonably have been discovered at the time of delivery, this does not affect a consumer’s statutory right to make a complaint.

14. Preparation of the delivery and installation site

Before the sauna arrives, the Customer must ensure that the location is properly prepared for delivery.

There must be sufficient access, a completed and suitable base, enough space for lifting and positioning, and no obstacles that make transport or unloading unsafe.

If the site is not ready on the agreed delivery date and the sauna cannot therefore be safely unloaded or positioned, repeat transport or additional services may result in additional charges.

15. Foundation and supporting surface

The sauna must be placed on a level, stable, horizontal and sufficiently load-bearing foundation or surface.

Depending on the installation location, a suitable base may include:

  • a concrete slab;
  • correctly installed concrete blocks;
  • a sufficiently strong terrace;
  • another structure designed for the weight of the sauna and local conditions.

The foundation must support the weight of the sauna itself as well as the sauna heater, sauna stones, possible chimney, accessories and loads arising during use.

The Customer is responsible for ensuring that the foundation is suitable and has sufficient load-bearing capacity.

Estcomhaus is not responsible for damage caused by a settling, uneven or insufficiently load-bearing foundation.

16. Assembly of a sauna supplied as a DIY kit

A sauna supplied as a DIY kit must be assembled in accordance with Estcomhaus assembly instructions.

Before assembly begins, the Customer must:

  • verify that the delivery is complete;
  • read the entire assembly instruction;
  • prepare a suitable and level foundation;
  • use appropriate tools and working methods.

If there is any uncertainty about how a component should be installed, the Customer must contact Estcomhaus before continuing the work.

Estcomhaus is not responsible for damage caused by incorrect assembly, failure to follow the instructions or structural modifications made without Estcomhaus approval.

This does not affect Estcomhaus responsibility for material or manufacturing defects in the supplied components.

17. Installation services in Sweden

Unless expressly stated otherwise in the quotation, on-site assembly or installation in Sweden is not included in the purchase or transport service.

The standard delivery therefore does not include:

  • construction of the foundation;
  • crane or lifting services;
  • assembly of a DIY sauna;
  • connection to the property’s electrical system;
  • water or drainage installation;
  • final installation of a wood-burning heater or chimney;
  • applications for building permits or other local approvals.

Where any of these services have been separately agreed, they will be stated in the quotation.

18. Electric sauna heater and electrical installation

The sauna is prepared at the factory for the electric sauna heater and electrical options stated in the order.

Different heaters may require different power levels, connections, control systems and installation methods. Depending on the heater, a three-phase electrical connection may be required.

Before placing the order, the Customer must ensure that the property can provide the electrical connection required for the chosen solution.

Factory preparation does not include the final connection of the heater or sauna to the Customer’s electrical installation in Sweden.

Electrical installation work in Sweden must be carried out by an electrical installation company registered with Elsäkerhetsverket for the relevant type of work.

Estcomhaus is not responsible for damage caused by:

  • incorrect voltage;
  • incorrect phase connection;
  • insufficient electrical supply;
  • incorrect protection devices;
  • an electrical installation that does not meet applicable requirements;
  • unauthorised modification of electrical equipment.

This limitation applies only where there is a causal connection between the incorrect installation or electrical condition and the damage concerned.

19. Wood-burning sauna heater and chimney

A wood-burning heater may only be selected for a sauna model designed for that type of installation.

Where a wood-burning heater is included in the order, the sauna is prepared for the heater and chimney solution stated in the approved specification.

The Customer is responsible for ensuring that the final installation in Sweden complies with applicable requirements concerning fire safety, safety distances, chimney construction and installation.

The Customer must also check which notifications, commencement approvals or other municipal approvals are required before the installation is taken into use.

Estcomhaus is not responsible for damage caused by an incorrectly installed heater or chimney at the installation site.

20. Building permits and local requirements

Before confirming the order, the Customer must verify the building, planning, fire safety and other local requirements that apply to installing the sauna on the relevant property.

The need for a building permit, notification or other approval may depend on, among other things:

  • the location of the property;
  • the applicable detailed development plan;
  • the size and height of the sauna;
  • its position on the property;
  • its distance from the property boundary;
  • existing buildings;
  • the chosen heating solution;
  • the chimney;
  • water and drainage installations.

Estcomhaus can provide available dimensions and technical product information that the Customer may require when communicating with the municipality.

The Customer is responsible for ensuring that all necessary local permits and approvals are obtained before the sauna is installed and put into use.

21. Snow load and local climate conditions

The standard snow-load capacity of each sauna model is stated in the relevant product sheet or individual order specification.

Before placing the order, the Customer must verify the structural requirements applicable at the installation location.

If the design snow load at the installation site exceeds the sauna’s standard specification, Estcomhaus must be informed before the order is confirmed.

Estcomhaus can then assess whether the structure can be reinforced or otherwise adapted for the relevant location.

Estcomhaus is not responsible for damage caused by snow load or other external loading exceeding the design capacity of the ordered structure where Estcomhaus was not informed of the relevant local requirements before the order was placed.

22. Cancellation by a consumer

If a private consumer wishes to cancel the sauna order before delivery, the Customer must notify Estcomhaus in writing as soon as possible.

Because the sauna is manufactured specifically for the individual Customer, Estcomhaus may already have ordered materials and components, carried out structural work, prepared recesses and connections for the heater, completed electrical preparations, prepared chimney penetrations or applied the Customer’s selected interior or exterior materials and finishes.

Where an order is cancelled, Estcomhaus is entitled to compensation for specific costs and other reasonable financial loss caused by the cancellation.

The calculation may include:

  • materials and components already purchased;
  • work already completed;
  • production preparation costs;
  • customer-specific work;
  • direct additional costs;
  • other reasonable financial loss.

The amount of compensation is assessed taking into account, among other things, the price of the order, the stage of production, the amount of work already completed, the degree of customisation and whether the completed or partially completed sauna can reasonably be sold to another customer.

If the sauna has already been substantially manufactured according to the Customer’s individual configuration and cannot be resold without substantial reconstruction or financial loss, the reasonable compensation may, depending on the circumstances, amount to the entire sum paid by the Customer.

If the amount paid in advance exceeds the compensation to which Estcomhaus is entitled under applicable law, the remaining amount will be refunded to the Customer.

23. Cancellation by a business customer

A business customer’s order becomes binding after written confirmation and payment.

A business customer does not have the right to cancel a custom-made sauna without cost after the order has been confirmed unless Estcomhaus agrees to the cancellation in writing.

If Estcomhaus agrees to a cancellation, any refund will be assessed according to:

  • the stage of production;
  • work already completed;
  • materials already purchased;
  • components already ordered;
  • customer-specific work;
  • the possibility of reselling the product;
  • other costs resulting from the cancellation.

In exceptional circumstances, Estcomhaus may agree to a full or partial refund where production and order preparation have not yet begun. This does not create a general right for a business customer to cancel an order free of charge.

24. Postponed delivery at the Customer’s request

If the sauna is ready but the Customer cannot accept delivery at the agreed time, the Customer must notify Estcomhaus as soon as possible.

Where delivery must be postponed for a reason attributable to the Customer, the Customer may be charged reasonable additional costs, including:

  • storage;
  • transport rescheduling;
  • repeat transport;
  • waiting time for the transport vehicle.

A new delivery date will be agreed separately.

25. Estcomhaus 2-year warranty

Estcomhaus provides a 2-year commercial warranty for saunas manufactured by Estcomhaus.

The warranty period begins when the sauna is handed over to the Customer, unless a longer warranty period is expressly stated in the individual quotation.

The warranty covers manufacturing defects, material defects and defects in Estcomhaus workmanship that become apparent during the warranty period and are not caused by incorrect installation, use, maintenance or another circumstance outside Estcomhaus responsibility.

Where a defect is covered by the warranty, Estcomhaus will assess the appropriate remedy according to the nature of the defect.

The 2-year commercial warranty does not limit a consumer’s statutory rights.

26. Warranty for sauna heaters and products from other manufacturers

Sauna heaters, control systems and other third-party products are subject to the relevant manufacturer’s warranty terms to the extent that the manufacturer has provided a warranty.

Where such a product has been purchased from Estcomhaus as part of the sauna order, a private consumer may also submit a statutory complaint to Estcomhaus as the Seller.

A manufacturer’s warranty does not replace or reduce the consumer’s statutory rights against the Seller.

27. Damage and defects not covered by the Estcomhaus commercial warranty

The Estcomhaus commercial warranty does not cover defects or damage to the extent that they are caused by:

  • normal wear and tear;
  • improper use;
  • failure to follow assembly or operating instructions;
  • incorrect assembly of a DIY sauna;
  • a settling, uneven or insufficiently load-bearing foundation;
  • incorrect electrical installation;
  • incorrect voltage or phase connection;
  • incorrect installation of a wood-burning heater or chimney;
  • damage caused during incorrect unloading or lifting;
  • insufficient or incorrect maintenance;
  • structural modifications made by the Customer or a third party without Estcomhaus approval;
  • a heater or other equipment not approved by Estcomhaus for the sauna, where that equipment caused the damage;
  • snow load or other loading exceeding the design capacity of the structure;
  • frost damage to systems not designed to be used with water at sub-zero temperatures;
  • flooding or other external water damage;
  • other external circumstances not caused by a material or manufacturing defect attributable to Estcomhaus.

An exclusion applies only where there is a causal connection between the relevant circumstance and the damage.

For example, electrical work performed by a third party does not automatically invalidate the warranty for the entire sauna where a later defect is unrelated to that electrical work.

28. Natural characteristics of wood

Wood is a natural material.

As a result of temperature, humidity, use and weather conditions, wood may change over time.

Natural changes may include:

  • variations in colour;
  • differences in grain and texture;
  • minor dimensional changes;
  • small surface cracks caused by drying.

Such natural characteristics are not in themselves considered material or manufacturing defects provided they do not materially affect the safety, load-bearing structure or normal use of the sauna.

29. Care and maintenance

The sauna must be used and maintained in accordance with Estcomhaus instructions and the instructions provided for the sauna heater and other technical equipment.

After use, the sauna must be allowed to ventilate and dry properly.

Interior wooden surfaces must be cleaned using products suitable for sauna environments.

Exterior wooden surfaces must be inspected regularly and treated when necessary, taking into account the surface treatment, weather conditions, exposure and use.

The sauna heater, chimney, control systems and other technical equipment must be maintained in accordance with the relevant manufacturer’s instructions.

30. Complaints and defect notifications

If the Customer discovers a possible defect in the sauna or in a product purchased from Estcomhaus, Estcomhaus must be contacted in writing at:

info@estcomhaus.com

The complaint should, as far as possible, include:

  • the Customer’s name and contact details;
  • order or invoice number;
  • sauna model;
  • description of the defect;
  • photographs;
  • video where appropriate;
  • the date on which the defect was discovered;
  • any other information necessary to assess the issue.

Where the problem may relate to electrical installation, sauna heater, chimney, assembly or other technical work, Estcomhaus may request additional documentation concerning the installation.

Before the Customer commissions extensive repairs from a third party, Estcomhaus must be given a reasonable opportunity to assess the defect and propose a solution, except where immediate action is necessary to prevent danger or greater damage.

31. Statutory complaint rights for private consumers

A private consumer in Sweden has a three-year statutory right to complain about defects for which the Seller is legally responsible.

A complaint must be made within a reasonable period after the Customer discovered or should have discovered the defect. A complaint made within two months after discovery of the defect is always considered to have been made within a reasonable time.

Where a defect becomes apparent within two years after the goods were handed over, Swedish consumer law generally presumes that the Seller is responsible for the defect unless the Seller proves otherwise or the presumption is incompatible with the nature of the goods or the defect.

The expiry of Estcomhaus 2-year commercial warranty does not automatically terminate the consumer’s statutory three-year complaint rights.

32. Remedy for an accepted complaint

Where Estcomhaus is responsible for an established defect, Estcomhaus must be given a reasonable opportunity to assess and remedy the defect.

Depending on the nature of the defect, the remedy may include:

  • repair;
  • replacement of a defective component;
  • delivery of a new component;
  • another appropriate corrective measure;
  • a price reduction where provided by law;
  • another remedy available to the Customer under applicable law.

The appropriate solution will depend on the nature of the defect, the possibility of repair and applicable law.

A consumer’s statutory rights, including rights to repair, replacement, price reduction or termination of the purchase where the legal conditions are met, are not limited by these terms.

33. Work carried out by third parties

Where the Customer independently appoints a third party to carry out:

  • lifting;
  • assembly;
  • electrical installation;
  • chimney installation;
  • foundation work;
  • water or drainage work;
  • other work related to the sauna,

the appointed contractor is responsible for carrying out that work correctly.

Estcomhaus is not responsible for damage caused by the work of a third party.

The use of a third party does not, however, release Estcomhaus from responsibility for a separate material or manufacturing defect in the sauna.

34. Heater or other equipment purchased independently by the Customer

If the Customer wishes to use a heater or other technical equipment that is not purchased from Estcomhaus, the solution must be approved in writing by Estcomhaus before production begins where installation of the equipment affects the sauna structure.

The Customer must provide all technical information required by Estcomhaus in good time, including where applicable:

  • exact model;
  • dimensions;
  • installation instructions;
  • safety distances;
  • electrical requirements;
  • control system;
  • chimney details;
  • other penetration requirements.

Estcomhaus is not responsible for manufacturing defects, warranty obligations or functionality of equipment purchased directly by the Customer from another supplier.

Estcomhaus remains responsible for the sauna structure and work carried out by Estcomhaus.

35. Circumstances outside Estcomhaus reasonable control

If performance of the order is prevented or significantly delayed by an extraordinary circumstance outside Estcomhaus reasonable control, Estcomhaus will inform the Customer as soon as possible.

Such circumstances may include, for example:

  • war or armed conflict;
  • major natural disasters;
  • government restrictions or prohibitions;
  • closure of borders or transport corridors;
  • another comparable and reasonably unforeseeable event.

Estcomhaus will take reasonable measures to limit the effects of the event and, where possible, complete the order or agree an alternative solution with the Customer.

This provision does not limit any mandatory statutory rights of a consumer.

36. Limitation of liability for business customers

This section applies only to business customers.

To the extent permitted by applicable law, Estcomhaus is not liable for indirect financial loss suffered by a business customer, including loss of profit, production losses, interruption of business or other indirect loss, unless the damage was caused intentionally or by gross negligence on the part of Estcomhaus.

To the extent permitted by law, Estcomhaus contractual liability towards a business customer is limited to the value of the relevant order.

37. Applicable law

The agreement between Estcomhaus and the Customer is governed by Estonian law.

Where the Customer is a consumer resident in Sweden, the choice of Estonian law does not deprive the Customer of the protection provided by mandatory Swedish consumer law that would otherwise apply and from which the parties cannot contractually derogate to the detriment of the consumer.

38. Dispute resolution

For any question, complaint or dispute relating to an order, delivery, warranty or product, the Customer must first contact Estcomhaus at:

info@estcomhaus.com

Estcomhaus and the Customer will first seek to resolve the matter through direct communication and a reasonable agreement.

Where a dispute with a Swedish private consumer cannot be resolved directly, the Customer may, provided the matter meets the applicable requirements, submit the dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN).

Disputes with business customers will first be addressed through negotiation and, if no resolution can be reached, by a competent court in accordance with applicable law.

39. Validity and amendments to these terms

The version of these Sales and Warranty Terms that was available to the Customer when the order was confirmed applies to that order.

Estcomhaus may amend these terms for future orders.

A later amendment does not change the terms applicable to an order that has already been confirmed unless Estcomhaus and the Customer separately agree to the change.

If any individual provision of these terms is found to be wholly or partly invalid, this does not automatically affect the validity of the remaining provisions.
